China PCC Power of Attorney: Apply Through a Representative

Already left China and need a China Police Certificate (PCC)? You may be able to apply through a representative without returning. Start by checking whether the office responsible for your former residence accepts an overseas application and what authorization it needs.

A China PCC power of attorney gives another person permission to act for you. Before you sign one, resolve three practical questions:

This guide helps you prepare that authorization, choose the right document route and avoid paying for certification before the format is settled. Global Attest’s China Police Certificate service can help review your available records, authorization requirements and China-side coordination options.

How to Apply for a China PCC Through a Representative: Step by Step

Use these five steps as a preparation roadmap. They are not a nationwide government procedure, and a representative does not guarantee issuance.

Step 1 — Confirm Your Former City and Residence Period

List where you lived, approximately when, and which passport you used. Identify the office that can assess the requested period. Keep separate city histories separate rather than treating your entire China stay as one local record.

Step 2 — Check the Local Authorization Requirements

Explain that you are overseas. Establish who may represent you, what authorization wording is accepted, and which supporting documents must be originals or copies. Include collection requirements in this enquiry.

Keep dated instructions, separating police-application requirements from later notarial requirements. Our PCC document requirements guide covers supporting identity and residence records.

Step 3 — Prepare Your Power of Attorney

Prepare the draft against that checklist. Review both parties’ identity details, the intended recipient and the tasks being authorized. Resolve old and current passport differences before arranging signatures.

Step 4 — Complete Notarization or Authentication If Required

Follow the confirmed execution route, including notarization, Apostille or consular legalization where applicable. Settle translation requirements too. These steps concern your overseas authorization for use in China; the final PCC’s overseas-use requirements are assessed separately.

Step 5 — Arrange Submission and Certificate Collection

Send the agreed document package to the representative. Plan how additional requests will reach you and who will retain the receipt. If a certificate is issued, arrange collection under the office’s instructions, then address any separately required translation, notarization or authentication.

Can You Apply for a China PCC Through a Representative?

The Ministry of Public Security’s criminal-record enquiry rules allow individuals to authorize another person to enquire for them. The representative must have full civil capacity—the legal ability to act independently. Delegated enquiries require a power of attorney and the representative’s valid identification, alongside the applicant’s materials.

The national framework identifies foreign applicants who have resided in China for at least 180 days and directs their applications to the relevant local exit-entry authority. It allows local implementation arrangements. Eligibility and overseas document acceptance therefore still need assessment; a POA alone cannot establish your residence history.

What Should Your China PCC Power of Attorney Include?

Shanghai’s official authorization-letter guidance says there is no standard template for that local procedure, but both the applicant and representative must be identified. Other offices may have their own wording.

Use this review list when preparing a draft. It is not a nationwide statutory format:

  • Your identity: the name and identification details the recipient requires.
  • Historical passport details: whether the passport used in China should also be identified.
  • Your representative: the individual authorized and their required identification.
  • Purpose and recipient: a clear connection to your China criminal-record enquiry.
  • Authorized tasks: submission, follow-up, supplying requested materials and collection where allowed.
  • City and period: any office or residence period that needs to be specified.
  • Signature and date: the accepted language, signing and witnessing arrangements.

Keep the powers relevant to this application rather than copying a broad banking or property POA. Where a company coordinates the case, establish which individual will attend and how the recipient expects that person to be named.

Does the Power of Attorney Need Notarization or an Apostille?

The national enquiry rules do not state that every China PCC authorization must be notarized or apostilled. Certain overseas routes do require those steps. Settle the accepted document form before paying for notarization or authentication.

Which country’s authentication route applies?

For the authorization, the destination is China. Your nationality and the country where you will eventually use the PCC do not, by themselves, determine its authentication route. The origin of the qualifying authorization document matters.

China’s official authentication guidance distinguishes Apostille routes from consular legalization. Where the Convention applies, an Apostille replaces the relevant consular legalization formality. Other routes may involve notarization, authentication in the issuing country and legalization by a Chinese embassy or consulate. The HCCH status table helps verify entry into force, objections and designated authorities.

What does an Apostille do?

The Apostille Convention covers official documents, including a notary’s act or certain official certifications of signatures. A private letter is not automatically eligible; the issuing authority must identify what official step is needed first. An Apostille verifies the signature, official capacity and, where relevant, seal on that document. It does not guarantee acceptance of the POA’s wording or your PCC application.

A reference for applicants in Canada

The Chinese Embassy in Canada’s guidance describes a notarized POA, Apostille and Chinese translation. It presents this as reference information and directs applicants to the competent Chinese authority for specific requirements. Clarify translator qualifications and supporting credentials; a bilingual draft may not satisfy a separate translation requirement.

Keep the two documents separate: authenticating your foreign POA for China does not authenticate the Chinese PCC for its overseas recipient. Each has its own requirements.

Shanghai PCC: What Do the Official Rules Say?

Shanghai’s official PCC guidance, updated September 23, 2026, describes eligibility involving at least 180 days with a residence permit and either a permit issued in Shanghai or actual residence there during that period.

For overseas applicants, it lists:

  • An original authorization letter, notarized where the applicant resides and then appropriately legalized or apostilled.
  • A copy of the bio page of the passport used during the Shanghai stay.
  • The representative’s original identification and a copy.

The procedure for applicants in China involves personal attendance and original historical passports and residence permits. Online applications are unavailable for the procedure described. Materials are subject to verification, with additional evidence possible.

The separate authorization FAQ identifies Chinese citizens or foreign nationals residing in Shanghai as possible representatives. Establish any residence evidence needed for your proposed representative. These are Shanghai instructions; our Shanghai PCC guide provides related city context.

Do You Need to Send Your Original Passport to China?

There is no single answer for every city and document stage. The Shanghai overseas example above cannot establish what another office—or a later notarial step—will accept.

Be precise about the requested format:

  • Original: the physical passport.
  • Ordinary copy or scan: a reproduction without separate certification.
  • Certified or notarized copy: a reproduction accompanied by a specific certification, whose issuer and form must be acceptable to the recipient.

Identify whether the request concerns the current passport, historical passport, particular pages or both documents. Certifying a passport copy is separate from notarizing your POA.

If the old passport is missing, describe what records you retain before booking certification or courier delivery. Our old or expired passport guide covers identity and historical record matching. Settle the full document route before sending a travel document overseas.

Can Your Representative Collect the Police Certificate?

Shanghai’s official guidance allows representative collection with the original application receipt. For another office, establish the collection authority, identification and receipt requirements alongside submission arrangements.

If different people submit and collect, resolve any additional authorization before filing. Keep track of the original receipt. Permission to collect a PCC should not automatically be treated as permission to handle later notarization, authentication or delivery.

Common Mistakes to Avoid

These are preparation risks, not claims about how frequently applications fail:

  • Signing before the recipient’s wording and execution requirements are settled.
  • Leaving out necessary follow-up or collection powers, or adding unrelated powers.
  • Overlooking differences between current passport details and historical records.
  • Choosing the POA’s authentication route using the PCC’s final destination.
  • Treating an ordinary scan and a certified copy as interchangeable.
  • Naming a representative whose eligibility or identification has not been checked.

If a problem is found after signing, arrange a review before further certification. Do not alter an already notarized or authenticated document yourself.

Real China PCC Cases Handled by Global Attest

Shanghai: missing historical residence documents

The Problem: A former Shanghai resident in France needed documents for Canada PR. Current and former passport scans were available, but historical visa, residence-permit and accommodation-registration copies were missing.

How Global Attest Helped: We reviewed the available records, prepared authorization documents and coordinated the application locally.

The Outcome: The PCC and notarized English translation were completed. Read the Shanghai case.

Multiple cities: applying while living overseas

The Problem: An applicant living in the United States needed PCCs for a Canada PR application involving residence in two Chinese cities and could not return in person.

How Global Attest Helped: We organized the residence history, prepared Chinese authorization wording and coordinated local submissions.

The Outcome: PCCs and the relevant notarial documents were obtained. Read the multi-city case.

Neither summary establishes a universal POA notarization or Apostille sequence, or shows that another applicant can omit the same records. They illustrate the record review and coordination involved in those individual cases.

Checklist Before Signing or Sending Documents

Before booking certification or sending originals, have these points settled:

  • Correct city, residence period and accepting office.
  • Overseas representative route and representative eligibility.
  • Draft identity details and authorized tasks.
  • Signing, notarization and any authentication arrangements.
  • Translation and original-or-copy requirements.
  • Current and historical passport differences.
  • Submission, collection and receipt arrangements.
  • Outstanding questions and overseas submission deadline.

Keep this checklist with your draft so unresolved questions are addressed before a paid document step.

Frequently Asked Questions

Is there one official China PCC authorization template?

The national rules reviewed do not prescribe one. Shanghai says it has no standard authorization-letter template. Use the recipient’s wording where provided rather than treating an online form as official.

Can a friend or relative act for me?

Potentially, if they meet the local representative criteria and can provide the required identification. The relationship alone does not establish eligibility.

Can one POA cover several Chinese cities?

The reviewed sources do not establish universal acceptance. Each office needs to accept the wording and document form. Also establish whether an office retains the original and how many originals you need.

Are electronic signatures or video notarization accepted?

Acceptance must be established for your route. A document valid in the signing country is not automatically accepted in that format by the Chinese recipient.

What if my POA is already notarized?

Keep it intact and have its wording, certification and language reviewed against the recipient’s requirements. Existing notarization does not automatically settle the remaining steps or mean you must start again.

Is representative handling the same as applying online?

No. You may stay abroad while your representative attends an office in China. Remote coordination and online government processing are different arrangements.
